Free Service

Non-registered users can access a limited quota of basic features for free. Specific quotas and restrictions are determined by us based on different regions and usage patterns, and may be adjusted at any time.

Registered User Service

Registered users can enjoy more model options and higher generation quotas. Specific benefits depend on subscription tiers.

Account Registration and Management

Registration Requirements

You must be at least 13 years old to use the Service
Users aged 13-16 require parental or guardian consent
You must provide accurate and complete registration information
One email address can only register one account

Intellectual Property

User Input Content Ownership

Generated Content Ownership

You own all rights to content generated by the Service for you (including text, images, audio, video, etc.), and can freely use, modify, and commercialize this content.

License Granted to TopickAI

To enable us to operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your input content, solely for the purpose of providing the Service to you. We will not use your content to train our own AI models.

Marketing Use

We may display anonymized use cases in marketing materials. If we wish to use identifiable content, we will obtain your explicit consent in advance.

User Obligations and Warranties

Content Legality Warranty

You warrant that:

You have legal rights to all content you upload/input
Your content does not infringe on any third party's intellectual property, privacy, or other rights
You have the right to authorize us to use your content as per these Terms
The content you generate and use complies with all applicable laws

Infringement Liability

If you upload infringing content (such as others' photos or audio) or impersonate others (such as cloning someone's voice without authorization), you bear all legal liability. We reserve the right to remove suspicious content and ban accounts.

Indemnification

You agree to indemnify and hold harmless TopickAI and its employees from any claims or demands (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Payment and Refunds

Subscription Terms

Access to certain features of the Service may require payment of subscription fees. Specific pricing and subscription tiers are published on our website.

Payment Methods

We process payments through Stripe. You are responsible for keeping your billing information up to date.

Refund Policy

Subscription fees are generally non-refundable, except in the following cases:

Major service failures preventing you from using the Service
Accidental subscription (within 24 hours of purchase and no paid features used)
Other circumstances required by local law

Service Availability and Disclaimers

Our Service relies on third-party AI model providers and infrastructure. TopickAI is not liable for service interruptions caused by third-party service failures.

Limitation of Liability

To the fullest extent permitted by law, TopickAI shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits or revenues
Loss or corruption of data
Any consequences arising from users' use of generated content

Termination and Suspension

TopickAI's Termination Rights

We may, at our sole discretion, terminate or suspend your account and access to the Service, with or without prior notice, for the following reasons:

Violation of these Terms
Engaging in conduct harmful to other users, us, or third parties
Suspected fraud or illegal activity
Extended inactivity (over 12 months)

User's Termination Rights

You may terminate your agreement with us at any time by deleting your account or ceasing to use the Service. After termination, you will lose access to all paid features, and paid fees will not be refunded (unless eligible under the refund policy).

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Arbitration Clause

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration conducted under the arbitration rules of the Hong Kong International Arbitration Centre (HKIAC). The place of arbitration shall be Hong Kong, and the language of arbitration shall be English.
